This Privacy Notice for FoodFluence ("we," "us," or "our") describes how and why we might access, collect, store, use, and/or share ("process") your personal information when you use our services ("Services"), including when you:

  • Download and use our mobile application (FoodFluence), or any other application of ours that links to this Privacy Notice
  • Use FoodFluence. FoodFluence connects creators with business owners to facilitate local marketing content on its platform, through social media channels.
  • Connect a Facebook Page or Instagram Business Account to FoodFluence
  • Connect a Gmail or Microsoft 365/Outlook mailbox to FoodFluence (see Section 17)
  • Engage with us in other related ways, including any sales, marketing, or events

1. WHAT INFORMATION DO WE COLLECT?

Personal information you disclose to us

In Short: We collect personal information that you provide to us and, where you authorize it, data accessed through Meta Platform APIs.

We collect personal information that you voluntarily provide to us when you register on the Services, express an interest in obtaining information about us or our products and Services, participate in activities on the Services, or otherwise contact us.

User Account Information. The personal information we collect may include:

  • Name
  • Email address
  • Phone number
  • Instagram username
  • Business information
  • Usernames
  • Contact or authentication data

Platform Usage Information. When you use the Services, we may automatically collect:

  • Login activity
  • Device and browser information
  • IP address
  • Campaign activity
  • Platform interactions

Sensitive Information. We do not process sensitive information.

Payment Data. We may collect data necessary to process your payment if you choose to make purchases, such as your payment instrument number and the associated security code. All payment data is handled and stored by StoryIt LLC. You may find their privacy notice here: http://www.storyit.app/privacy.

Application Data. If you use our application(s), we also may collect the following information if you choose to provide us with access or permission:

  • Push Notifications. We may request to send you push notifications regarding your account or certain features of the application(s). You may opt out in your device settings.

This information is primarily needed to maintain the security and operation of our application(s), for troubleshooting, and for our internal analytics and reporting purposes.

Meta Platform Data

When you connect a Facebook Page or Instagram Business Account, FoodFluence may access the following data through Meta Platform APIs, as authorized by the account owner:

  • Instagram Business Account ID
  • Instagram Username
  • Facebook Page ID
  • Facebook Page Name
  • Business Account Information
  • Messaging permissions and message content for authorized accounts
  • Published content information
  • Post performance metrics
  • Audience analytics
  • Insights data

We access Meta Platform Data only with your authorization and only to provide the functionality described in Sections 2 and 3. You may revoke this access at any time (see Sections 9 and 10).

All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.

Google API

Our use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.


2. HOW DO WE PROCESS YOUR INFORMATION?

In Short: We process your information to provide, improve, and administer our Services, facilitate marketing campaigns, communicate with you, for security and fraud prevention, and to comply with law.

FoodFluence uses collected information to:

  • Create and manage user accounts
  • Facilitate influencer marketing campaigns
  • Match creators with businesses
  • Process campaign participation
  • Communicate with users
  • Improve platform functionality
  • Provide reporting and analytics
  • Request feedback
  • Protect our Services, including fraud monitoring and prevention
  • Administer prize draws and competitions
  • Comply with our legal obligations

Meta Data Usage

Meta Platform Data is used solely to:

  • Connect Instagram Business Accounts
  • Authenticate connected accounts
  • Publish approved content
  • Manage Instagram messaging functionality
  • Retrieve account insights and analytics
  • Generate campaign performance reports
  • Support platform features requested by users

We do not use Meta Platform Data for any purpose other than delivering the functionality you authorize and that is approved by Meta Platforms.


3. META PLATFORM DATA — PERMISSION-SPECIFIC DISCLOSURES

This section describes the specific Meta permissions FoodFluence requests and how data obtained under each permission is used.

Instagram Content Publishing

FoodFluence may publish content to connected Instagram Business Accounts when authorized by the account owner. Content is published only after the account owner approves it within the platform.

Instagram Insights

FoodFluence may retrieve and display Instagram account performance metrics, including:

  • Reach
  • Impressions
  • Engagement
  • Follower metrics
  • Content performance analytics

This data is used to generate campaign reporting and analytics for the connected account owner.

Instagram Messaging

FoodFluence may facilitate sending and receiving Instagram messages through authorized business accounts, solely to support campaign coordination and platform features requested by users.


4. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?

In Short: We may share information in specific situations described in this section. We do not sell your personal information or Meta Platform Data.

FoodFluence does not sell Meta Platform Data or personal information to third parties.

We may share information only in the following situations and with the following parties:

  • Service providers supporting platform operations, pursuant to a written contract
  • Cloud hosting providers
  • Payment providers
  • Legal authorities, when required by law or to exercise, establish, or defend our legal rights
  • Meta Platforms, where necessary for Meta API functionality
  • Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
  • Google Maps Platform APIs. We may share your information with certain Google Maps Platform APIs (e.g., Google Maps API, Places API). Google Maps uses GPS, Wi-Fi, and cell towers to estimate location to provide directions.

We require each service provider to protect your information under a written contract and to use it only for the purposes for which it was disclosed.


5. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?

In Short: We may use cookies and other tracking technologies to collect and store your information.

We may use cookies and similar tracking technologies (like web beacons and pixels) to gather information when you interact with our Services. Some online tracking technologies help us maintain the security of our Services and your account, prevent crashes, fix bugs, save your preferences, and assist with basic site functions.

We also permit third parties and service providers to use online tracking technologies on our Services for analytics and advertising. To the extent these technologies are deemed a "sale"/"sharing" under applicable US state laws, you can opt out by submitting a request as described in Section 12.

Google Analytics

We may share your information with Google Analytics to track and analyze use of the Services. To opt out of being tracked by Google Analytics across the Services, visit https://tools.google.com/dlpage/gaoptout. 6. HOW LONG DO WE KEEP YOUR INFORMATION?

In Short: We keep your information only as long as necessary to provide our Services, fulfill legal obligations, resolve disputes, and enforce agreements.

FoodFluence retains information only as long as necessary to provide services, fulfill legal obligations, resolve disputes, and enforce agreements, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). No purpose in this notice will require us to keep your personal information for longer than the period in which you have an account with us.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it, or, if this is not possible, securely store and isolate it from further processing until deletion is possible.


7. HOW DO WE KEEP YOUR INFORMATION SAFE?

In Short: We aim to protect your personal information through organizational and technical security measures.

FoodFluence employs commercially reasonable administrative, technical, and physical safeguards designed to protect user information, including:

  • Encryption in transit
  • Secure cloud infrastructure
  • Access controls
  • Authentication safeguards
  • Industry-standard security practices

However, despite our safeguards, no electronic transmission over the internet or information storage technology can be guaranteed to be 100% secure. Transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment.


8. DO WE COLLECT INFORMATION FROM MINORS?

In Short: We do not knowingly collect data from or market to children under 18 years of age.

We do not knowingly collect, solicit data from, or market to children under 18 years of age, nor do we knowingly sell such personal information. By using the Services, you represent that you are at least 18, or that you are the parent or guardian of such a minor and consent to the minor's use of the Services. If we learn that personal information from users under 18 has been collected, we will deactivate the account and take reasonable measures to promptly delete such data. 9. WHAT ARE YOUR PRIVACY RIGHTS?

In Short: You may review, change, or terminate your account at any time, and disconnect Meta-connected accounts.

Depending on where you are located, you may have the right to:

  • Access your information
  • Correct inaccurate information
  • Request deletion of your information (see Section 10)
  • Disconnect Meta-connected accounts
  • Withdraw platform permissions

Disconnecting Meta-connected accounts. You may disconnect a connected Facebook Page or Instagram Business Account at any time through your FoodFluence account settings or through your Meta account settings at https://www.facebook.com/settings?tab=business_tools. Disconnecting revokes FoodFluence's access to that account's Meta Platform Data going forward.

Withdrawing your consent. If we are relying on your consent to process your personal information, you have the right to withdraw consent at any time by contacting us. This will not affect the lawfulness of processing before withdrawal.

Opting out of marketing communications. You can unsubscribe at any time by replying "STOP" or "UNSUBSCRIBE" to our SMS messages, or by contacting us. We may still send service-related messages necessary for the administration of your account.

Account Information. To review or change your account information or terminate your account, contact us using the information provided. Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases, though we may retain some information to prevent fraud, troubleshoot problems, assist investigations, enforce our legal terms, and/or comply with applicable legal requirements.

Cookies. Most browsers accept cookies by default. You can set your browser to remove or reject cookies, though this could affect certain features or services.

10. DATA DELETION REQUESTS

Users may request deletion of their FoodFluence account and associated Meta Platform Data by contacting:

Upon verification of your identity, FoodFluence will remove applicable account information and associated Meta Platform Data within a reasonable period, unless retention is required by law.

To disconnect Meta-connected accounts without deleting your FoodFluence account, see Section 9.


11. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and applications include a Do-Not-Track ("DNT") feature you can activate to signal your privacy preference. No uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals. California law requires us to disclose that, because there is currently no industry or legal standard for recognizing or honoring DNT signals, we do not respond to them at this time.


12. DO UNITED STATES RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

In Short: If you are a resident of certain US states, you may have specific rights regarding your personal information.

If you are a resident of California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Montana, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah, or Virginia, you may have the right to request access to and details about the personal information we maintain, correct inaccuracies, obtain a copy of, or delete your personal information. You may also have the right to withdraw consent. These rights may be limited in some circumstances by applicable law.

We may also collect other personal information when you interact with us in person, online, by phone, or by mail in the context of customer support, surveys or contests, and delivery of our Services.

Your Rights

You have rights under certain US state data protection laws, including:

  • Right to know whether we are processing your personal data
  • Right to access your personal data
  • Right to correct inaccuracies
  • Right to request deletion
  • Right to obtain a copy of the personal data you previously shared
  • Right to non-discrimination for exercising your rights
  • Right to opt out of processing for targeted advertising, sale of personal data, or profiling

Depending on your state, you may also have the right to obtain a list of categories or specific third parties to which we have disclosed personal data, and the right to limit the use and disclosure of sensitive personal data.

How to Exercise Your Rights

To exercise these rights, submit a data subject access request, email us at hello@foodfluence.ai, or use the contact details at the bottom of this document. You may designate an authorized agent to make a request on your behalf, subject to verification.

Request Verification. Upon receiving your request, we will verify your identity. We will only use personal information provided in your request to verify your identity or authority. If we cannot verify your identity from information already maintained by us, we may request additional information.

Appeals. If we decline to act on your request, you may appeal by emailing us at hello@foodfluence.ai. If your appeal is denied, you may submit a complaint to your state attorney general.

California "Shine The Light" Law. California residents may request, once a year and free of charge, information about categories of personal information disclosed to third parties for direct marketing purposes. Submit requests in writing using the contact details in Section 15.


13. META PLATFORM COMPLIANCE STATEMENT

FoodFluence complies with the Meta Platform Terms, Meta Developer Policies, and applicable privacy regulations. Data obtained through Meta APIs is used only for functionality authorized by users and approved by Meta Platforms.


14. DO WE MAKE UPDATES TO THIS NOTICE?

In Short: Yes, we will update this notice as necessary to stay compliant with relevant laws.

We may update this Privacy Notice from time to time. The updated version will be indicated by an updated "Last updated" date at the top of this Privacy Notice. If we make material changes, we may notify you by prominently posting a notice or by directly sending you a notification. We encourage you to review this Privacy Notice frequently.

You have the right to request access to the personal information we collect from you, details about how we have processed it, to correct inaccuracies, or to delete your personal information. You may also have the right to withdraw your consent. These rights may be limited in some circumstances by applicable law. To request to review, update, or delete your personal information, submit a data subject access request or email hello@foodfluence.ai.


17. Connected Email Accounts (Google and Microsoft)

1. Overview

Foodfluence allows authorized brand owners and administrators to connect a Gmail or Microsoft 365/Outlook mailbox to the platform. This integration enables brands to send creator invitations, manage email conversations, review replies, and use AI-powered email outreach features directly within Foodfluence.

Only users with the appropriate permissions can connect and manage a brand’s mailbox. By connecting an account, the authorized user permits Foodfluence to access and process the mailbox data necessary to provide the selected features, subject to the permissions granted and the limitations described in this policy.

2. Information We Access

Depending on the email provider, permissions granted, and features enabled, Foodfluence may access the following information:

  • Basic account information: Your email address, name, and basic profile information needed to identify the connected account.
  • Sending permissions: Permission to send emails from the connected mailbox, including creator invitations and replies.
  • Email conversation data: Relevant email messages sent to or received from creators contacted through Foodfluence, including message content, subject lines, sender and recipient addresses, timestamps, and information needed to associate replies with the correct conversation.
  • Limited historical messages: Where required to provide conversation management, Foodfluence may access relevant messages from the preceding 90 days, limited to conversations associated with creators invited through Foodfluence.
  • Email metadata: Information needed to manage message delivery, identify threads, synchronize conversations, and maintain outreach status.
  • Attachment metadata: Attachment names and file sizes where available. Foodfluence does not intentionally store attachment contents as part of the email conversation records described in this section.
  • Authentication information: OAuth access tokens and refresh tokens required to maintain the connection and renew access when permitted by the provider.

The exact information available depends on the permissions granted by the user and the capabilities of the connected email provider.

3. Email Provider Permissions

For Google accounts, Foodfluence may request the following OAuth permissions, as applicable:

  • openid, email, and profile to identify the connected account.
  • gmail.send to send email messages.
  • gmail.readonly to read relevant email messages for conversation management.
  • Offline access, where required, to maintain the connection without requiring the user to authenticate again for every operation.

For Microsoft accounts, Foodfluence may request the corresponding permissions, as applicable:

  • openid, email, and profile to identify the connected account.
  • Mail.Send to send email messages.
  • Mail.Read to read relevant email messages for conversation management.
  • offline_access to renew access where supported and authorized.

Foodfluence requests permissions based on the functionality being provided. Access to email content is intended to be limited to the conversations and information needed to provide the connected-mailbox features.

4. How We Use Email Information

Foodfluence uses connected email information to provide and operate its email outreach and conversation-management features, including:

  • Sending creator invitations from a brand’s connected email address.
  • Receiving, synchronizing, and displaying creator replies within Foodfluence.
  • Maintaining email threads and conversation history.
  • Tracking outreach status and supporting follow-up workflows.
  • Drafting and, where authorized by the applicable feature settings, sending replies.
  • Supporting customer service, technical troubleshooting, security, and other legitimate platform operations.

AI Agents and Automated Replies

Foodfluence’s AI agents may read relevant email conversations to understand their context, summarize communications, classify messages, determine appropriate next steps, and draft replies.

Where an AI-powered feature is enabled and authorized, an agent may also send a reply or perform a related email action in accordance with the feature’s configuration and applicable authorization. The specific actions an agent can take depend on the features enabled for the brand.

Email content may be processed by AI service providers, including OpenAI, to generate classifications, summaries, recommendations, or reply drafts and to provide other requested AI-powered functionality. Such processing is performed to deliver Foodfluence’s services.

Customer Support Access and Sending on a Brand’s Behalf

Authorized Foodfluence Customer Support personnel may access relevant email conversations when reasonably necessary to provide customer support, investigate issues, troubleshoot the platform, or resolve other platform-related matters.

Where necessary for these purposes, Customer Support personnel may also send emails from a brand’s connected mailbox on the brand’s behalf. These communications are limited to platform-related purposes, such as resolving support requests, investigating technical issues, or addressing matters directly related to the use and operation of Foodfluence. They are not intended for unrelated marketing or personal communications.

Access by Customer Support is limited to authorized personnel and the information reasonably necessary to perform their duties, subject to applicable access controls and security safeguards.

Platform Operations and Security

Foodfluence may process relevant email information to maintain reliable service operation, investigate technical failures, protect accounts, prevent abuse, enforce platform rules, and comply with applicable legal obligations.

5. Email Data Storage and Retention

Foodfluence may store email conversation records and related metadata necessary to provide the email outreach features.

Stored information may include:

  • Sender and recipient addresses.
  • Email subject lines and message text.
  • Message timestamps and conversation identifiers.
  • Outreach and delivery status information.
  • Attachment names and sizes, where available.

Email message text stored by Foodfluence may be limited to 20,000 characters per message. Attachment contents are not included in the email conversation records described in this section.

Email conversation records covered by this section are automatically deleted within 90 days after the email was sent, subject to applicable operational requirements and any shorter deletion period available under the service. Users may contact Foodfluence to request deletion sooner.

Certain limited operational, security, or audit records may be retained for longer where reasonably necessary for security, dispute resolution, legal compliance, or legitimate service operations. Such records should be limited to the information needed for those purposes.

6. Security and Authentication

Foodfluence uses OAuth-based authorization to connect to Google and Microsoft accounts. Foodfluence does not ask users to provide their email account passwords directly to the platform as part of this connection process.

Access tokens and refresh tokens used to maintain mailbox connections are encrypted at rest and stored on the server side. They are not intended to be exposed to ordinary client-side application code.

Foodfluence uses appropriate technical and organizational safeguards designed to protect connected email data against unauthorized access, disclosure, alteration, or destruction. However, no storage or transmission method can be guaranteed to be completely secure.

7. Sharing of Email Information

Foodfluence does not sell connected email data or use it for advertising or unrelated profiling.

Email information may be shared with service providers when necessary to operate the platform, including:

  • Google Cloud and Firebase: For infrastructure, hosting, storage, and related platform operations.
  • OpenAI and other applicable AI service providers: To process relevant email content when needed to provide AI-powered features such as classification, summarization, and reply generation.

These providers process information as necessary to provide their services to Foodfluence, subject to the applicable contractual terms and data-protection safeguards.

Foodfluence may also disclose information where required by law, valid legal process, or to protect the rights, safety, and security of Foodfluence, its users, or others.

Foodfluence does not authorize service providers to use connected email data for unrelated purposes. Foodfluence does not use connected email content to train general-purpose AI models. Email content sent to AI providers is processed to provide the requested platform functionality, subject to the applicable provider terms and data-use settings.

8. Google API Services User Data Policy

Foodfluence’s use and transfer of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.

9. Disconnecting an Email Account and Revoking Access

Users can disconnect a connected mailbox through Settings → Integrations within Foodfluence.

Users can also revoke Foodfluence’s access directly through their email provider:

After a mailbox is disconnected or its permissions are revoked, Foodfluence can no longer use that connection to send or read email messages, subject to any provider-side processing or already-authorized operations that may be in progress.

Disconnecting an account does not necessarily delete email conversation records already stored in Foodfluence. Those records are deleted according to the retention periods described above, or sooner where an applicable deletion request is fulfilled.

10. Your Choices and Requests

Users can manage connected email accounts through Foodfluence and can revoke the permissions granted to Google or Microsoft at any time.
